When is Loan Act available?
The Loan Act list is available based on state laws that impact document language or selection of documents. A loan act can be selected for the following jurisdictions: CO, GA, IA, ID, IN, KS, LA, ME, MN, MO, NM, OK, SC, TN, TX, UT, WI, WV, and WY. A loan act may not be available in the list for a specific state because the state's law governing lending does not apply to the document language or selection for a transaction. The blank option that displays in the list should be selected if you are lending in a state that is not in the list above or the loan act does not impact the document language for your transaction.
Examples of Loan Act availability
- If your jurisdiction is Illinois, and you are lending under The Interest Act, the document language is not impacted so Loan Act will not be available on the Loan Definition page.
- If your jurisdiction is Iowa and you are lending under the Purchase One-To-Two Family Dwelling, the Loan Act will be available on the Loan Definition page with Blank and Uniform Consumer Credit Code options. Because Purchase One-To-Two Family dwelling does not impact the document language, select the blank option.
- If your jurisdiction is Iowa and you are lending under the Uniform Consumer Credit Code, select Uniform Consumer Credit Code in the Loan Act list that is available. Selecting this option prints “This is a consumer credit transaction” below the title on the Consumer Note.
- If your jurisdiction is South Carolina and you are lending under the Consumer Protection Code, select Consumer Protection Code in the Loan Act list. Selecting this option includes the Notice Of Agency To Receive Complaints document in the document list during the application phase.
