Conclusion: Advertising Deposit Accounts

The Truth-in-Savings Act and Regulation DD contain most of the rules affecting deposit account advertising. See our Truth-in-Savings section toward the end of the manual for details. Some other federal regulations do affect deposit account advertising, however. The FDIC and NCUA require banks and credit unions, respectively, to include a reference to deposit insurance in account advertisements. The NCUA has other regulations which simply prohibit being deceptive or misleading in your advertisements.

State law may also affect your deposit account advertising. Some states have a version of a “Truth-in-Savings” law regulating advertising. Also, many states have “Deceptive Trade Practices” acts that prohibit false or misleading advertising. You should check with your local counsel for information about any laws your state might have in these areas and whether they affect deposit account advertising.
